Terms of Product Purchase
This document set out terms and conditions (“the purchase terms) under which you may purchase from Allgood Journey products appearing on this website. By completing the customer application process and placing an order from this website, an agreement exists between you and Allgood Journey once Allgood Journey accepts the order. Each accepted order constitutes a separate and binding agreement.
Revisions
Allgood Journey may revise the purchase terms at any time in its absolute discretion by posting revised terms, and these revisions will be effective immediately. If any of the terms are found to be unenforceable, you agree that the remainder of the purchase terms remain in full force and effect.
Customer Application
If you do not already have an Account you will need to create one before placing an Order, unless you utilise the “Guest Checkout” feature of the Website. You may not set up an Account for someone else. Please ensure that you enter all information carefully when creating an Account. You warrant to Allgood Jourey that all information provided by you in relation to your Account is complete, true and accurate You must notify Allgood Journey immediately if you become aware of any actual or potential unauthorised use of your Password or Account. Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law), Allgood Journey will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of: (i) your Account information being incomplete or inaccurate; or (ii) any unauthorised use of your Password or Account which takes place before you notify Allgood Journey, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.
Orders
You place an order with Allgood Journey by following the instructions on the website. Please ensure that you enter all information carefully when placing an Order. Allgood Journey reserves the right to accept or reject an order for any reason including without limitation, unavailability of product; an error in the price, image or the product description; or error in your order. Orders are deemed received by Allgood Journey at the time of successful transmission of the order, and you will thereafter be unable to cancel the order. Orders are deemed accepted by Allgood Journey upon Allgood Journey acknowledging such order or failing to reject such order within 14 days. Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law), Allgood Journey will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of your Order information being incomplete or inaccurate or as a result of being unable to change or cancel your Order once it has been accepted by Allgood Journey, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.
Product Availability
Allgood Journey uses its best endeavours to ensure products ordered are available for delivery, and in most cases will notify you where a product is unavailable prior to you completing your order. However you acknowledge that in some cases this is not possible and Allgood Journey may need to reject an order you have placed for a product where Allgood Journey establishes that it is actually unavailable for delivery. In such cases Allgood Journey will refund in full all amounts you paid in respect of such unavailable product.
Pricing and Taxes
All prices and delivery charges are quoted on the website in Australian dollars and are inclusive of GST. Allgood Journey reserves the right to change the prices of Goods at any time without notice to you. The price displayed at the time that you place your Order will continue to apply to you even if the price changes before your Order is accepted by Allgood Journey. By placing an Order you agree to pay the price for the Goods, any Delivery Charge and any Additional Delivery Charge.
Payment
You must pay for your products purchased on this website at the time of placing an order. We accept Paypal, Mastercard and Visa.
Variation of Products and Price
Allgood Journey may vary the prices on this website at any time, and prices are subject to change until you have paid for the products in full.
Delivery
Delivery terms included delivery areas, delivery costs and estimated delivery times are contained in Allgood Journey's Delivery information on the website. Deliveries will be made to you by one of Allgood Journey’s employee, contracted delivery drivers or courier companies. Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law), Allgood Journey will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of the delivery of the Goods, including, where arising as a result of:
(a) any third party interference;
(b) any late or lost deliveries; or
(c) the Goods being misdirected.
Refunds and Returns
Change of mind and customer guarantee return claims, are detailed in Allgood Journey's Refunds and Returns Policy. The Refunds and Returns Policy is expressly incorporated in these Purchase Terms. Please refer to this policy to determine your entitlement to a return, and the process that you need to follow.
